Welcome to caretogether.org. These Terms of Service (“Terms”) govern your access to and use of this public website (the “Site”) operated by CareTogether Inc. (“CareTogether,” “we,” “our,” or “us”).

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Scope of These Terms

These Terms apply to the public website only.

These Terms do not govern the use of the CareTogether software platform by customer organizations or their users. Use of the CareTogether platform is governed by separate agreements between CareTogether and the applicable organization.

2. Who May Use the Site

You may use the Site only in compliance with applicable law and these Terms.

3. Permitted Use

You may use the Site for lawful, informational, and legitimate business purposes, including learning about CareTogether and contacting us.

You agree not to:

  • use the Site in violation of any law or regulation;

  • interfere with or disrupt the Site or its security;

  • attempt to gain unauthorized access to the Site, systems, or accounts;

  • scrape, copy, or harvest Site content or data in an abusive or unauthorized way;

  • introduce malware, harmful code, or other malicious material;

  • use the Site to infringe the rights of others; or

  • misrepresent your identity or affiliation when contacting us.

4. Website Content

The Site and its contents, including text, design, graphics, logos, and other materials, are owned by or licensed to CareTogether and are protected by applicable intellectual property laws.

You may view and use the Site for your own lawful internal or informational purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit Site content except as allowed by law or with our written permission.

5. Information on the Site

We try to make the Site helpful and accurate, but the Site is provided for general informational purposes only. We do not guarantee that all content is complete, current, or error-free.

Nothing on the Site is legal, medical, compliance, or professional advice.

6. Privacy

Your use of the Site is also subject to our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding privacy matters, the Privacy Policy will control for those privacy matters.

7. CareTogether’s Role as a Service Provider

CareTogether provides software and related services to organizations. If an organization uses CareTogether to store information about individuals or to contact them through CareTogether, CareTogether acts as a service provider to that organization.

That organization—not CareTogether—determines what information is collected in the platform, how it is used, and whether the individual has provided any required notice, permission, or consent.

8. Third-Party Links

The Site may contain links to third-party websites or services. We provide those links for convenience only. We do not control and are not responsible for third-party websites, services, or content.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

CARETOGETHER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will always be available, uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARETOGETHER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARETOGETHER’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.

11. Indemnity

You agree to defend, indemnify, and hold harmless CareTogether and its officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of the Site or your violation of these Terms.

12. Changes to the Site or These Terms

We may update the Site or these Terms from time to time. When we update these Terms, we will post the revised version on the Site and update the “Last Updated” date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

13. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction and venue of those courts.

14. Severability

If any provision of these Terms is found unenforceable, the rest of the Terms will remain in effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and CareTogether regarding your use of the Site.
